TEMA ENERGY SA, with registered office in Soseaua Vergului, Nr.14A, Corp C, Etaj 1, Bucuresti, Sector 2, Romania (hereinafter referred to as “TEMA ENERGY” or “the Company” or “the Company”), manages your personal data explicitly for the agreed/communicated purposes.

General information

The confidentiality of your personal data is a priority for TEMA ENERGY SA, as data controller. Therefore, the Company constantly seeks to ensure the processing of personal data in strict compliance with data protection principles.

This Policy on the protection of personal data (“Policy”) concerns the processing of personal data of users www.tema-energy.ro , respectively www.datacenter-forum.ro (‘Website’, “Site”), of participants in events organized by Tema Energy SA, of the Company’s business partners, as well as of other persons who contact or visit the Company and their representatives, potential employees and applies to data collected through the Website, as well as other personal data we collect through e-mail service or other offline contacts.

The Policy has been developed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“General Data Protection Regulation”) and contains information on the requirements applicable to the protection of the processing of personal data.

Purposes of data processing

TEMA ENERGY processes personal data solely in accordance with the applicable laws and regulations relating to such processing, to establish and fulfill its contractual obligations, to comply with legal obligations, to protect the legitimate interests of the Company or in accordance with your consent, as applicable.

In particular, the Company processes personal data necessary for the exercise of its rights and obligations as an employer, counterparty in various legal relationships and agreements, for the fulfillment of its obligations to tax, insurance, customs and other international, state and local authorities and bodies, as well as for auditing and ensuring compliance with domestic laws and regulations. It also processes personal data to protect access to its facilities, maintain and improve investor relations, promote the company’s activities, address legal issues and protect its legitimate interests.

Whose and what personal data is processed

The personal data processed relates to the Company’s individual physical customers and representatives of legal entities – customers, third party collaborators or subcontractors, visitors, and job applicants. Data refers to:

  – Contact data such as name, profession, employer, work address, e-mail address and telephone number

   – Identity information to enter and stay safely in the Company premises, such as identity card/passport/residence permit number, vehicle registration number

   – Photo-video material from our Company’s public events attended by the above

   – Information about the browser or device you use to access our website.

In addition for customers, third party collaborators and subcontractors:

 – Payment, delivery and invoicing details

 – Documents required for third parties operating on our premises

Or for job applicants:

 – Name, home address, address, e-mail address, telephone number and documents required for verification

 – Date of birth, marital status, nationality

 – Details of pension insurance scheme

 – Employment and education history

 – References

 – Any other information you can provide through the documents you send us.

In case you are a participant to the events organized by TEMA ENERGY SA

We use your relevant personal data for the purpose of preparing and allowing  your participation in DATA CENTER FORUM events. For example, it may be necessary to use your relevant personal data in order to organise events on areas of interest to you. participation in the course is provided by someone else, e.g. your employer). Also, the legal basis for processing personal data is the performance of our contract (if you have registered for the event) or our legitimate interest in ensuring your participation in the event (if your participation in the course is ensured by another person, e.g. your employer).

Who is processing your personal data

Processing is limited to what is absolutely necessary and is carried out by our Company, as well as by third party collaborators and subcontractors on our behalf, to ensure the successful fulfillment of the agreed purposes. Personal data is not sold to anyone.

Personal data is shared with third parties who are essential for the providers of the services and products requested and for facilitating the agreed collaboration between you and our Company or with the competent authorities, as part of our legal obligations.

Personal data may be sent to third party collaborators and subcontractors, including their EU/EEA and non-EU/EEA establishments in cases related to the local sales network.

Cloud services may be used in EU/EEA facilities.

Using social platforms

Through our presence on social platforms, the usage data generated there and the plug-ins, we offer you even more interesting information about our products and the possibility to interact with social networks and other users, allowing us to optimize our platform and make it more interesting for you as a user.

The legal basis for the use of usage data generated as a result of our presence on social platforms and for the use of plug-ins is Article 6 para. 1. Clause 1 (f) of the GDPR.

The data transfer takes place regardless of whether you have an account with the plug-in provider and are logged in with the plug-in provider or not. If you are connected with the plug-in provider, your data that has been collected by us is directly associated with your existing account with the plug-in provider. If you click on the activated button and, for example, link the page, the plug-in provider also stores this information in your user account and distributes it publicly to your contacts. We recommend that you log out regularly after using a social network, but especially before you press the button, if you want to avoid association with your profile by the plug-in provider.

In addition, we cannot influence the data collected or the data processing operations, nor do we know the full scope of data collection, the purposes of data processing and the storage periods. We also do not hold information about the deletion of data collected by the plug-in provider.

The plug-in provider stores the data collected about you in the form of usage profiles and uses it for advertising, market research and/or design purposes according to the requirements of its website or web site.

Such evaluation takes place in particular (for users who are not logged in) to present advertisements according to your requirements and to inform social network users about your activities on our website. You have the right to object to the creation of these user profiles. To exercise this right, you should contact the respective plug-in provider.

Protecting your personal data

It is the intention of our Company to ensure that adequate safeguards are in place to protect your personal data at any stage or location of processing.

Our company, as well as our subcontractors, collaborating parties when used, are obliged to take appropriate organizational and technical measures to ensure the protection of personal data against unauthorized access, use, disclosure, loss and unauthorized alteration.

In all cases, the processing of personal data shall be carried out by persons or functions which are assigned with specific tasks that require such data processing.

Storage of personal data

In order to fulfill the above purposes for processing your data, we will retain the data for a period that is related to the agreed purposes.

However, we may retain such data further if required to do so by law or for the Company’s proportionate legitimate interests, until such interests are no longer in force.

Automated decision-making and profiling

There is no automated decision-making, including profiling, for your personal data.

Your rights as Data Subjects

Please note that you have the following rights:

  2. To request correction of the data
  3. To request erasure of data, object to the processing of such data or request restrictions on the processing of such data. Please note that this may cause disruptions in collaboration and/or the provision of services, depending on the specific purposes for which the data are processed.
  4. For information collected only with your consent, you may withdraw your consent.Please note that in some cases the above rights may be subject to certain exceptions, conditions or prior requirements, for example in cases 3 and 4, we may need to further process this data if required to do so by law or for the Company’s proportionate legitimate interests, until such interests are no longer in force.
  5. If you believe that we are not processing your personal data lawfully or that we have not sufficiently respected your rights as set out above, you have the right to lodge a complaint to the supervisory authority in the country where you reside, work or TEMA ENERGY.
